Top Legal Risks and Responsibilities for Association & NFP Leaders

Most associations and not-for-profit (NFP) organisations are overseen by volunteer boards and supported by paid staff who deliver services to members and the community. In recent years, these organisations have faced growing pressure to reduce risks by ensuring compliance with relevant laws and regulations. Failure to comply can lead to significant consequences, including fines and potential litigation.

Our next webinar AES have invited our AES Legal Practitioners who will address some of the key governance legal issues from our research they include:

  • Overview of the regulatory bodies for NFP organisations
  • What are the fiduciary duties of Office Bearers, Board Members, and CEO?
  • Can non-performing Board members be sacked?
  • Does the Chair have ultimate authority by just being elected or appointed?
  • What risk management issues should every Association Board member be aware of? (Recent Australian Case Studies)
  • What happens if our Board does not follow the constitution?
  • Managing Board Conflicts of Interest
  • What should our association be aware of if it needs to merge or wind up?
